Terms of Service
These Terms of Service (“Terms”) govern your access to and use of FlowPulse’s website (https://www.flowpulse.xyz) and the FlowPulse product (including the application and API). By using FlowPulse, you agree to these Terms. If you do not agree, do not use the service.
Who we are
FlowPulse is operated by Philippe Mathew De Vera, an individual based in Philippines. Contact: philmattdev@gmail.com.
The service
FlowPulse provides workflow observability features such as ingesting run-related events, surfacing status and history, reporting, and alerts—subject to the product as offered at any given time. Features may change, and we may add or remove functionality as we develop the product.
Eligibility and accounts
You must be able to form a binding contract in your jurisdiction and meet any minimum age requirements that apply. You are responsible for your account credentials and for all activity under your account. Notify us promptly if you suspect unauthorized access.
Acceptable use
You agree not to:
- Violate applicable law or infringe others’ rights;
- Probe, scan, or test the vulnerability of the service without authorization;
- Interfere with or disrupt the service, networks, or security (including sending malware, overload attempts, or abusive traffic);
- Attempt to access data or accounts you do not have permission to access, or reverse engineer the service except where applicable law permits;
- Use the service to build a competing offering by misappropriating our proprietary materials;
- Misrepresent your identity or affiliation.
We may investigate and suspend or terminate access for violations or risk to the service or other users.
Your data
You retain rights in data you submit to FlowPulse. You grant us a limited license to host, process, transmit, and display that data solely to provide and improve the service, protect security, and comply with law. You represent that you have the rights needed to submit the data you send us. Our Privacy Policy explains how we handle personal information.
Third-party services
You may connect FlowPulse to third-party tools (for example automation platforms). Those services are governed by their own terms and policies. We are not responsible for third-party services you choose to use.
Fees
If you purchase a paid plan, fees, billing cycles, and taxes are as shown at checkout or in your account. Unless stated otherwise, fees are non-refundable except where required by law or explicitly offered in writing.
Intellectual property
FlowPulse and its branding, software, and content are protected by intellectual property laws. Except for the limited rights expressly granted to use the service, these Terms do not grant you any rights in our intellectual property.
Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLOWPULSE AND ITS OPERATOR WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE THREE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) FIFTY US DOLLARS (USD $50), IF YOU HAVE NOT PAID ANYTHING. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
Indemnity
You will defend and indemnify FlowPulse and its operator against claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the service, your data, or your violation of these Terms, to the extent permitted by law.
Termination
You may stop using the service at any time. We may suspend or terminate access if you breach these Terms, create risk or legal exposure, or if we discontinue the service (with reasonable notice where practical). Provisions that by their nature should survive will survive termination (including disclaimers, limitations, and indemnity).
Governing law
These Terms are governed by the laws of the Republic of the Philippines, without regard to conflict-of-law rules. Courts in the Philippines will have exclusive jurisdiction, subject to mandatory consumer protections that may apply where you live.
Changes
We may update these Terms from time to time. We will post the updated Terms on this page and update the “Last updated” date. If a change is material, we will provide additional notice when practical. Continued use after changes become effective constitutes acceptance of the updated Terms.
